Frank has over 25 years of experience in the federal district courts and state trial courts litigating complex commercial cases on behalf of plaintiffs and defendants. His experience is heavily weighted towards antitrust law, consumer class action litigation, and high-value business tort and contract disputes.

Frank is a graduate of Emory Law School. After clerking for the Honorable Stanley F. Birch, United States Court of Appeals for the Eleventh Circuit, Frank joined Bondurant Mixson & Elmore, where he has spent his career.

Antitrust law is a particular area of focus, in which Frank has served as lead counsel in defending and prosecuting plaintiff’s class actions, pursuing single-plaintiff antitrust claims on behalf of large institutions, and defending merger challenges by the Federal Trade Commission and Department of Justice. Frank has been recommended for antitrust litigation by Chambers for over a decade, and Chambers currently rates him one of only four “Band One” antitrust litigators in Georgia, just as Chambers rates Bondurant, Mixson & Elmore as one of only four “Band One” antitrust litigation firms in Georgia. Best Lawyers in America recognized Frank as the 2020 “Lawyer of the Year” for antitrust litigation.

Success in any practice area requires attentive and effective client service. In 2015, Frank was one of 120 litigators nationwide recognized by BTI for “Cream of the Crop” for client service in complex litigation, based solely upon interviews with in-house counsel. Under BTI standards, “[t]he only way to become a BTI Client Service All-Star is for corporate counsel to single out an attorney for client service exceeding all others”.

  • Represented one of the world’s largest airlines in a variety of class action lawsuits filed around the country asserting claims under Sections 1 and 2 of the Sherman Act.
  • Represented one of the country’s largest tax preparation services in the defense of Sherman Act Section 1 and 2 claims.
  • Represented independent contractors in a Sherman Act Section 1 claim against the nation’s largest residential insulation contractor and the major manufacturers of fiberglass insulation.
  • Represented one of the country’s largest tire manufacturers in prosecuting antitrust and trademark claims against a tire “retreader.”
  • Represented a cigarette manufacturer in the defense of Sherman Act claims alleging price-fixing in the cigarette industry.
  • Represented a carpet manufacturer in conjunction with a criminal investigation of alleged price-fixing in the carpet manufacturing industries.
  • Represented a dairy in criminal and civil proceedings alleging bid-rigging in the sale of milk to elementary and secondary schools in Georgia.
  • Represented a seller of motorsports memorabilia in the defense of Sherman Act claims alleging price-fixing in the sale of souvenirs marketed at motorsports events.
